6 News has learned new information on a Johnstown police captain who is facing felony theft and deception charges as it now appears that he may have most of those charges dropped in some sort of deal with prosecutors.

Cambria County authorities say this is the first time that Captain Michael Plunkard faced such charges.

Court documents show that Plunkard is having an Accelerated Rehabilitative Disposition (ARD) hearing next week.

He faces felony charges of theft by failure to make requested funds and theft by deception – false impersonation.

According to a probable-cause affidavit, Plunkard allegedly stated online, in May, that he was looking to sell a Jeep.

Investigators say a woman reportedly told Plunkard that she was interested in buying the vehicle for somebody.

The affidavit states he claimed that he still had a “small” loan on the Jeep, however, investigators later discovered that Plunkard still owed tens of thousands of dollars on the vehicle.

Court documents say that Plunkard allegedly used an abandoned Chevy Tahoe, worth a few hundred dollars, to secure a loan for the Jeep.

According to the commonwealth, ARD is the program intended to encourage offenders to make a fresh start for the possibility of having their charges dismissed.

The courts say charges can be dropped if the defendant cooperates at the ARD hearing.

Cambria County District Attorney Greg Neugebauer says Plunkard’s future as a law enforcement officer with the city of Johnstown is “up to the department.”

When we asked the Johnstown police chief if he will allow Plunkard to continue his job, he responded with “no comment at this time.”

We also reached out to Johnstown city manager Ethan Imhoff with the same question, and we were immediately declined comment and were not allowed to enter his office.

Court officials say the ARD hearing is scheduled for December 19th.

As for where Plunkard’s dog Achie has been during this time, officials say they are not commenting on that either.
